1. Vous voulez créer une section syndicale d’un syndicat de branche professionnelle USAPIE qui a moins de 2 ans d’ancienneté : c’est le président d’USAPIE qui crée la section syndicale et nomme le RSS, une union de syndicats s’approprie les adhérents du syndicat de branche qui adhère. En procédant de la sorte, la section syndicale remplie les conditions légales indispensables à sa création que sont : avoir au moins 2 adhérents et une ancienneté d’au moins deux ans dans le champ professionnel et géographique que lui procure USAPIE.
2. Le président du syndicat national de branche crée la section syndicale USAPIE en nommant un Représentant Syndical de Section par courrier recommandé avec AR adressé à l’employeur, conformément à l’article. L. 2142-1.du code du travail : « Dès lors qu’ils ont plusieurs adhérents dans l’entreprise ou dans l’établissement, chaque syndicat qui y est représentatif, chaque syndicat affilié à une organisation syndicale représentative au niveau national et interprofessionnel ou chaque organisation syndicale qui satisfait aux critères de respect des valeurs républicaines et d’indépendance et est légalement constituée depuis au moins deux ans et dont le champ professionnel et géographique couvre l’entreprise concernée peut constituer au sein de l’entreprise ou de l’établissement, une section syndicale qui assure la représentation des intérêts matériels et moraux de ses membres, conformément à l’article L. 2131-1. »
